Rules

1. General Terms
1.1 These Terms (hereinafter referred to as the "Terms") shall govern the use of the WellStore online store (hereinafter referred to as the "E-Store"). The Terms shall apply when the Buyer orders and purchases goods offered in the E-Store or otherwise uses the services of the E-Store.
1.2 Upon the Buyer's order of goods, these Terms shall become the terms of the purchase contract between the Buyer and the Seller, which shall constitute a binding legal document for both parties. The Contract shall be deemed to be concluded when the Buyer places an order for goods or goods in the E-shop.
1.3 The Buyer shall not be entitled to order goods in the E-shop if the Buyer has not read the Terms and Conditions or does not agree to them. If the Buyer orders goods, the Buyer shall be deemed to have read the Terms and to have fully accepted them.
1.4 The Seller shall assume no risk or liability and shall be fully indemnified if the Buyer has partially read the Terms or has not read them at all, even if the Buyer has had the opportunity to do so.

2. Processing of personal data
2.1 In order to use the E-Shop and purchase the goods offered therein, the Customer must fill in the order form. The order form must contain the following personal data of the Buyer: name, surname, e-mail address, address where the goods will be delivered, telephone number, other data relevant for the delivery of the goods.
2.2 The Buyer is responsible for ensuring that the data provided in the order is accurate, correct and complete. The Seller shall in no event be liable for any damages suffered by the Buyer or third parties as a result of the Buyer providing incorrect or incomplete data.
2.3. The personal data provided by the Buyer shall be processed in accordance with the requirements of the data protection laws of the European Union (hereinafter - EU) governing the processing and protection of such data. In processing and storing the Buyer's personal data, the Seller will use organisational and technical means to ensure the protection of personal data from accidental or unlawful destruction, alteration, disclosure or any other unlawful processing.
2.4 By making a purchase the Buyer agrees that his personal data will be used for marketing and he agrees to receive advertising and informational messages from the E-store.

 

3.Prices, payment terms and terms of payment
3.1.The prices of the goods in the E-shop order are indicated in Euro. Goods shall be sold to the Buyer at the prices prevailing in the E-shop at the time of payment of the order.
3.2 The Buyer shall pay for the Goods by prepayment or post-payment. The responsibility for data security rests with the relevant financial institution as the money transactions take place in its system.
3.3 Payment shall be deemed to have been made when the full amount has been received and credited to the Seller's account. The price for the supply of the Goods is inclusive of VAT. Only on receipt of payment for the Goods and the delivery charge shall the order be executed and the delivery date determined.

 

4. Packing and Delivery
4.1 The Goods shall be delivered only within the territory specified by the Seller. The e-shop will only accept an order if the delivery address entered is within the specified territory. The goods shall be delivered by the Seller's business partners or an authorised representative.

4.2 If the delivery of the goods is not possible due to the Buyer's fault or circumstances beyond the Buyer's control (the Buyer has entered an incorrect address, the Buyer or the recipient cannot be found at the address entered, the address entered cannot be accessed, etc.)4.3 The Seller shall be exempt from liability for breach of the delivery terms if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or circumstances beyond the Buyer's control.
4.4 If the Buyer notices that the shipment does not contain the correct quantity of goods or that the goods delivered do not correspond to the order and this is not stated in the delivery document, the Buyer must notify the Seller at the time of receipt or delivery of the goods, otherwise the order shall be deemed to have been duly placed or delivered and the goods shall correspond to the order.
4.5 In the event that the goods are returned to the Shop, the Buyer shall reimburse the Seller for any loss incurred in packing and posting the goods to the address specified by the Buyer. The Buyer must also pay the cost of returning the returned goods to the Shop. Payment must be made within 3 working days of the invoice being sent to the email address provided by the Buyer when ordering the goods. In case of delay in payment, the collection of the costs shall be transferred to a third party debt collection company.

 

5.Quality guarantee and expiry date
5.1.The characteristics of all goods sold in the E-shop are specified in the description of each item.
5.2.The Seller is not responsible for the fact that the goods in the E-shop do not correspond to the actual size of the goods in colour, shape and other parameters.
5.3.Goods that have a specified expiry date are delivered so that the Buyer has the opportunity to use these goods until the expiry date.
5.4 Each product or group of products has its own warranty period, during which the Seller shall repair or replace the product at its own expense.
5.5 In order to hand over the product for repair or replacement, it must be carefully packed in accordance with the Seller's instructions and handed over to the Seller's representative - courier.
5.6 In the event that, through the Buyer's fault,
a) incorrect contact details (telephone no., delivery address) or other information related to the exchange of the product;
b) upon arrival of the courier, the product to be delivered is not properly prepared for shipment;
c) the courier's telephone call is not answered;
re-call of the courier for the return of the defective product shall be at the Buyer's expense.

6. Right of withdrawal. Refund
6.1 If the Buyer is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who wishes to purchase, purchases or could purchase or use a good or service for a purpose unrelated to his business or professional activity), the Buyer may exercise the right of withdrawal and unilaterally withdraw from the contract (purchase of goods in the E-shop) within 45 calendar days (as specified for each individual item) after the date of ordering the relevant goods. The Buyer may not exercise the right of withdrawal if:
6.1.1. goods are delivered which are made to the consumer's specifications or are irreplaceable items or by their nature cannot be returned or are perishable or expendable;
6.1.2. foodstuffs, beverages or other goods for immediate household consumption are delivered;
6.1.3. in other cases provided for by law.
6.2 The Seller shall refund the price of the goods returned by the Buyer exercising the right of withdrawal after acceptance of the goods. The Buyer shall be responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal. The Buyer shall be liable for any diminution in the value of the goods if the goods have been used in a manner incompatible with the principle of good faith, including use for purposes other than ascertaining the nature or performance of the goods. The goods must be undamaged, not have lost their appearance (labels not removed or damaged, protective films not torn, etc.) and not have been used. The goods must be returned in their original packaging, in the same condition as when received. If the goods are not complete, damaged, untidy or not properly packed, the Seller has the right not to accept the goods and not to refund the money paid by the Buyer for the goods.
6.4 The Buyer shall bear the costs of delivery of the goods to the shop (except for goods that do not comply with the terms of the contract). If the Buyer wishes to return the goods on delivery, they must be returned to the Seller's delivery agent (courier). In such case, the Buyer shall not be relieved of the costs incurred in packing the goods, delivering them to the address indicated and returning them to the Shop.

 

7.Exchange of information
7.1 The Seller shall send all notices and otherwise communicate with the Buyer using the e-mail address or telephone number provided in the Buyer's order form.
7.2 The Buyer shall send all notices and enquiries using the means and addresses provided in the "Contact" section of the E-shop.

 

8. Final Terms
8.1 The relationship between the Buyer and the Seller shall be governed by these Conditions as well as by EU law.
8.2 In the event of a loss, the Party at fault shall compensate the other Party for direct damages in accordance with EU law.
